MAKING A RESERVATION/BOOKING

Capture Quests prioritizes personalized service and caters to small groups, resulting in high demand for spaces and trips. To ensure your participation and avoid disappointment, it is essential to reserve your spot in advance. Your reservation will be confirmed upon receipt of your deposit. If you wish to reserve an additional activity or excursion within 48 hours of the starting date, kindly reach out to us first to verify availability.

TRIPS DEPOSIT

All trips require a $1,000 USD deposit to confirm the reservation. The full balance is due on or before 60 days from the workshop start date. If your reservation/booking is being made within 30 days of the scheduled trip departure, payment in full is required.

CANCELLATIONS / NO-SHOW / LATE ARRIVAL / NON-COMPLETION OF ACTIVITY

  • We are not liable for, do not offer refunds for, or otherwise accommodate cancellations, no-shows, late arrivals, or the non-completion of a workshop for any reason including but not limited to acts of God or government, transportation delays, medical emergencies, etc. (except weather conditions, which are contemplated elsewhere herein) except as discussed below:

  • If you cancel your reservation more than 60 days prior to your trip start time, we will refund your payment minus your deposit and a 3.5% transaction fee. Your deposit is not refundable but transferable to another CaptureQuests workshop.

  • If you cancel your reservation between 30 and 60 days prior to your trip start time, we will refund 50% of your payment minus your deposit and a 3.5% transaction fee.

  • For cancellations made less than 30 days before the tour/trip start time or failure to show, the entirety of your deposit and fees are non-refundable.

  • Late arrival – we understand that sometimes things happen; however, please keep in mind that our tours run on a schedule, and due to logistical reasons, if you are running late, we will do our best but may not be able to wait for you. In the event that you arrive late and your tour has already left, the deposit is non-refundable and non-transferable. We strongly recommend you secure travel insurance to prepare for such circumstances.

  • If a workshop participant chooses not to complete the full activity, no partial refund will be given. In the event that a workshop participant chooses not to complete the course, any partial refund given will be at the sole discretion of CaptureQuests and their local tour partners.

  • Cancellations prior to workshop due to sickness or other medical conditions: we require a written statement from a licensed physician prior to the scheduled start of the workshop or activity confirming such sickness or medical condition; in which case we will work with you to attempt to transfer your reservation to another workshop or activity, or, if rescheduling is not, at our sole determination and discretion, viable, we may refund your deposit in whole or in part. No refunds are available for sickness or other infirmity incurred after the start of any workshop or activity.

SCHEDULE AND SCHEDULE CHANGE

  • We know your Holiday & Vacation time is precious, and you are planning your vacation days out. Every effort is always made to adhere to activity schedules. Capture Quests reserves the right to alter activity schedules if it is in the best interest of the client or when weather conditions demand. Every effort will be made to inform you of these changes as early as possible.

MINIMUM PARTICIPANT REQUIREMENT

  • Our workshops and activities are subject to a minimum participant requirement for operation. We reserve the right to reschedule or cancel any activity or workshop that does not meet the minimum participant requirement forty-eight hours prior to the scheduled start of the tour.

  • Participants who have their workshop or activity cancelled due to a lack of minimum participants will be offered the opportunity to reschedule to another workshop or activity date, if available, or receive a full refund of the amount paid for the workshop or activity. No further compensation will be provided in the event of cancellation due to not meeting the minimum participant requirement.

WEATHER CONDITIONS

  • Weather Cancellation Criteria

1.1. Weather-related cancellations are applicable in cases where, at our sole determination, safety concerns arise due to severe weather conditions that could pose a risk to participants, staff, or property, or where such weather affects our ability to effectively conduct our workshop. Such conditions may include, but are not limited to, extreme or sustained storms, hurricanes, blizzards, heavy rainfall, lightning storms, or any other weather event that poses a significant threat or creates conditions for a delay significant enough to warrant rescheduling.

1.2. Weather forecasts and official weather advisories from recognized meteorological agencies will be the primary sources of information used to determine the severity of weather conditions.

  • Notification and Communication

2.1. In the event of a weather-related cancellation during a travel photography workshop, we will make every effort to inform participants as soon as possible. Notifications will be issued through the communication channels provided during the registration process (e.g., email, phone, SMS).

2.2. Participants are encouraged to check their communication channels before departing for the workshop to receive any updates or notifications from our team.

  • Refund Options:

3.1. If a workshop or activity is canceled due to adverse weather conditions, participants will be entitled to one of the following refund options:

a. Reschedule: Participants may choose to reschedule their workshop for a future date, subject to availability and any applicable terms and conditions.

b. Credit: Participants may receive a credit voucher or gift card equivalent to the amount paid, which can be used towards a future workshop or related services within a specified period. The validity and terms of the credit voucher will be communicated at the time of issuance.

c. Partial Refund: In cases where rescheduling or credit options are not feasible or desired, participants may request a partial refund of the deposit or workshop fee paid by participant, which takes into account any non-recoverable expenses incurred by the workshop organizer, at our sole determination, up to the cancellation date.

d. Full Refund: If rescheduling, credit, or partial refund options are not feasible or desired, participants may, at our sole determination, be eligible for a full refund of the deposit or workshop fee  paid by the participant. However, a processing fee or non-refundable deposit, if applicable, may be deducted from the total refund amount.

e. Any refund issued by us, whether partial or full, shall only encompass deposits or workshop fees actually paid by participants and explicitly excludes reimbursements or refunds for ancillary or extraneous costs such as, but not limited to, airfare, hotels, meals, etc.

  • Refund Request Process:

4.1. To initiate a refund request, participants must contact our workshop organizer through the designated channels mentioned in the workshop documentation or website.

4.2. Refund requests should include relevant details such as participant name, contact information, workshop date, and the reason for the refund request.

4.3. Our workshop organizer will review the refund request and respond within a reasonable time frame, providing further instructions and clarifications if necessary.

  • Limitations and Exceptions:

5.1. This refund policy is applicable only to weather-related cancellations during the travel photography workshop and does not cover other circumstances, such as participant no-shows, personal preference changes, or other non-weather-related issues.

5.2. Refunds or rescheduling options for weather cancellations are subject to the terms and conditions of the specific workshop or service booked. Certain workshops or activities may have their own unique policies, which will be communicated during the registration process.

5.3. In cases where third-party vendors or partners are involved, the refund policy may be subject to their respective terms and conditions.

Please note that this refund policy is designed to provide fair and reasonable solutions in the event of weather-related cancellations. It is subject to change and may be updated without

PROHIBITION ON THE USE OF ALCOHOL & INTOXICANTS

The use of alcohol or any other intoxicating substances is expressly forbidden prior to or during our activities. Should you be found engaging in such activities, you may be immediately removed from the activity or course, with no eligibility for a refund. If you arrive to participate in an activity noticeably under the influence of alcohol or other intoxicants, you will be immediately dismissed without a refund.

RISK ACKNOWLEDGEMENT AND ASSUMPTION

Participating in the activities we offer, including open water and underwater activities, inherently carries certain risks, including physical or mental injury, pain, illness, temporary or permanent disability, emotional distress, and even death. Specific risks may emerge from actions, inactions, or negligence, on your part or that of others, or from the conditions of the location or facility where the activities are taking place. These risks may also encompass natural phenomena, labor disputes, social instability, itinerary modifications, equipment malfunctions, accidents, or other unforeseen events. Sometimes, medical assistance may not be readily accessible, including emergency healthcare or medications. Every participant must fully understand and voluntarily accept these inherent risks upon the decision to engage in the activity and is personally accountable for any resulting consequences. In instances where the participant is a minor, the accompanied parent/guardian is liable for the minor's wellbeing and health.

In consideration for being granted permission to participate in the activities, you must consent to WAIVE CLAIMS, DISCHARGE, AND EXEMPT us, our officers, directors, employees, agents, and leaders from any liability arising from, or in connection with any injury, even those potentially induced by the negligence of our officers, directors, agents, and leaders, in any context relating to the activity. You must further agree to INDEMNIFY us, our officers, directors, employees, agents, and leaders against any claims, damages, injuries, or losses triggered by your own negligence while participating in the activities as well as any risks that are part of the activities but not explicitly contemplated herein.

STUDENT REQUIREMENTS / RESPONSIBILITIES

For diving workshops, divers are required to present proof of certification to the minimum level required before participating in any dive activities. Please bring your certification card with you, whether it be plastic or digital. If you are unable to provide proof of certification, you will not be able to dive and may forfeit your tuition paid. Students may be required to read and sign the Standard Safe Diving Practices Statement of Understanding before they start their dive/snorkel trip.

PHYSICAL FITNESS

Workshop student acknowledges being in good physical condition for diving/snorkeling/hiking. Any student with a pre-existing medical condition or illness must declare the true nature of such condition at the time of participation in the activities. They may be required to provide a medical statement from a General Practitioner stating that they are ‘medically fit’ to participate in the physical activities required. CaptureQuests and its staff will treat all information with the strictest of confidence.

USE OF LIKENESS

You understand that during your participation in the activities, you may be photographed or videotaped. To the fullest extent permitted by law, you agree to waive all rights of publicity, privacy, or pre-approval that you may have for use of your likeness in such context(s), or use of your name in connection with your likeness, and you will grant to us permission to copyright, use, and publish (including by electronic means) such likeness, whether in whole or in part, in any form, whether altered or not, without restriction, and for any purpose whatsoever. MISCELLANEOUS

While we strive to ensure a safe and enriching experience, we serve merely as facilitators for the participants, arranging their photography, sightseeing, meals, transportation, instruction, and lodging. We bear no responsibility for injury, theft, loss, accident, or delay due to defects, defaults, or any actions of any company or individual involved in conveying the participant or conducting any activity aspect. We disclaim liability for losses or expenses stemming from, but not limited to, acts of God or government, weather, strikes, warfare, civil unrest, terrorism, quarantine, etc. Such losses or expenses are solely the participant's responsibility. We also do not cover other participant expenses, including non-refundable airline tickets or credit card fees.

ARBITRATION

You must agree that any dispute, claim or controversy arising out of or relating to our services or the breach, termination, enforcement, interpretation or validity of any agreement you enter into with us, will be submitted to arbitration to be conducted in the state of Texas, and judgment on the arbitration award shall be final and may be entered into any court having jurisdiction thereof, and will be binding upon you, your heirs, executors, successors, and assigns. Such binding arbitration shall be administered by the American Arbitration Association ("AAA") pursuant to the Federal Arbitration Act, 9 U.S.C., 1, et seq, and in accordance with the Commercial Arbitration Rules of the AAA that are in effect at the time the demand for arbitration is filed, unless the parties mutually agree otherwise in writing. The prevailing party shall have the right to collect from the other party its reasonable costs and attorney’s fees incurred in enforcing this agreement.

INSURANCE

Capture Quests is committed to safe diving practices and injury prevention. We recommend that if you intend to go scuba diving, you make sure you have an insurance policy that covers this activity. Some travel insurances do cover scuba diving and some do not. There are several scuba diving insurance companies to choose from; among the most popular for international travel are Dive Assure and Divers Alert Network.
